1. Learned counsel for the petitioner submits that he may be permitted to withdraw this petition for the moment with a prayer that since subsequently the trial itself having been concluded and the accused persons having been convicted, he has now moved an application for release of the ornaments under Section 452 CrPC which is pending consideration before the court below and as such he does not want to press the present application which was under Section 451 CrPC which was earlier filed.

2. State counsel does not oppose the same.

3. Accordingly, the present petition is dismissed as withdrawn. However, taking into consideration the fact that application under Section 452 CrPC is pending consideration before the court below for more than one and half year, it is directed that the court below shall try to dispose of the same at the earliest.
