Heard on I.A. No. 1 of 2016, which is an application moved by the Petitioner for recalling the stay granted by this Court on 15.10.2015. 2.

The said application has not been opposed by the Counsel appearing for Respondent No.2-Complainant.

On 15.10.2015, this Court had while taking cognizance of the petition had issued notice to the Respondents and meanwhile an interim protection was also granted to the extent of the further proceedings of the case, i.e., Criminal Case No. 12947 of 2015, pending before the Court of Judicial Magistrate First Class, Raipur to remain stayed till the next date of hearing.

Meanwhile, the learned Counsel for the Petitioner today makes a submission that the parties are in the process of mediation/negotiation for an out of court settlement and submits that therefore at this juncture

-2he may be permitted to withdraw the present Criminal Misc. Petition and the interim order may also be recalled with a liberty that in case situation so arise he may be permitted to re-agitate the same by way of a fresh proceeding.

Learned Counsels for the Respondent do not oppose the same. 6.

The present Criminal Misc. Petition stands dismissed with the aforesaid liberty. The interim order also stands vacated. Sd/- (P. Sam Koshy) Judge /sharad/
