The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 72/2015 registered in Police Station Gudhiyari, Dist. Raipur (C.G.) for offence punishable under section 307, 34 IPC & u/s 25, 27 of Arms Act.

As per the prosecution case, the brother of the complainant Mukesh namely Vikash he had dashed the applicant Manjit while going on a motorcycle. Thereafter, it leads to altercation. Subsequently, the applicant along with others came to the house of the complainant Mukesh and called for Vikash and when he was not available, this applicant assaulted Mukesh by way of gupti and the other accused also assaulted whereby he sustained severe injuries and thereafter a report being made offence was registered.

Learned counsel for the applicant submits that there was no

intention to assault and weapon used in offence has not been seized by the police, however kitchen knife has been seized, therefore he submits that it becomes doubtful and the applicant may be enlarged on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Having regard to the fact that seizure has already been made of knife and the way the offence has been committed, considering the fact case is fixed for evidence, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
