1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.177/2020 registered at Police Station Pamgarh, District Janjgir-Champa (CG) for the offence punishable under Section 376 of the IPC and Section 6 of the Protection of Children from Sexual Offences Act, 2012.

3. Despite there being no objection from the parents of the prosecutrix for release of the applicant on bail, this Court is not inclined to release the applicant for the reason that the prosecutrix was aged 14 years 2 months, when the subject incident happened.

4. Accordingly, the bail application is rejected reserving liberty to the applicant to revive the prayer after examination of the prosecutrix.
