This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 363/2015, registered at Police Station Balco Nagar, District Korba, C.G., for the offence punishable under Section 376 of IPC and Sections 4 & 6 of Protection of Children from Sexual Offences Act.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; manner in which sexual intercourse is said to have been committed by the applicant with the minor girl, aged about 11 years; her statement recorded under Section 164 Cr.P.C. and other evidence available, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
