Hon'ble Justice Shri Gautam Chourdiya Order on Board 23/11/2020 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 03/08/2020 in connection with offence under Section 454, 323 & 376 of the Indian Penal Code registered at Police Station Chakradhar Nagar, District Raigarh (C.G.) under Crime No. 198/2020.

2) At the very outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
