Hon'ble Justice Shri Gautam Chourdiya Order on Board 23/11/2020 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 16/06/2020 in connection with offence under Sections 457 & 380 of the Indian Penal Code registered at Police Station D.D. Nagar Raipur, Civil & Revenue District Raipur (C.G.) under Crime No. 116/2020.

2) At the very outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
