1. The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.05/2020, registered at Police Station Bakarkatta, District Rajnandgaon (C.G.) for the offence punishable under Section 302 of IPC.

The applicant has committed murder of his brother Manjit Ram by strangulating him after dispute and altercation for sharing chicken meat.

According to learned State counsel, the incident has been witnessed by atleast 3 witnesses namely Itwarin Bai, Man Singh

and Ram Kunwar. She would read statement of these 3 witnesses.

Having appreciated the material available in the case diary, I am not inclined to release the applicant on bail at this stage. 5.

Accordingly, the bail application is dismissed with liberty to revive the prayer after examination of Itwarin Bai, Man Singh and Ram Kunwar.
