This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and no other bail application is pending before any other Court.

2. The applicant has been arrested in connection with crime No. 113/2019 registered at Police Station -Akaltara, District- Janjgir-Champa (C.G.) for the offence punishable under Section 34(1)(d), 34(2) and 36 of the C.G. Excise Act.

3. Case of the prosecution, in brief is that on 05.04.2019, 7.380 bulk liters country made liquor have been seized from the applicant.

Govt. Advocate submits that nine other criminal cases have been reported in the police case diary against the applicant, out of which three are under Excise Act, one under IPC and five under Cr.P.C.

5. Counsel for the applicant further submitted that applicant has been acquitted in two Excise cases and in one Excise case he is only sentenced for fine. 6.

Looking to the above facts and circumstances of the case, looking to the fact that nine other criminal cases have been registered against the applicant, the application is rejected.
