1. This application under Section 438 Cr.P.C. has been preferred by the applicant apprehending his arrest in connection with Crime No.554 of 2020 registered in Police Station -Sarkanda, District Bilaspur (CG), for alleged commission of offence under Sections 294, 323, 506, 326 and 325 of IPC.

2. Learned counsel for the applicant, at this stage, seeks to withdraw this application by submitting that the applicant is willing to surrender and apply for grant of regular bail before the Court below. He would submit that in the back ground that the applicant already lodged FIR against the complainant, the Court below may be directed to decide the application for

grant of regular bail on the same day.

3. Considering the submission made, the application is dismissed as withdrawn with the liberty as prayed for.

4. In case the applicant surrenders and moves application for grant of regular bail before the Court below, the same shall be considered and decided at the earliest preferably within three days.
