1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.28/2020 registered in Police Station Police Chowki Morga, Thana- Bango, District Korba, C.G. for the offence punishable under Section 457, 380 of the I.P.C.

3. Case of the prosecution, in brief, is that applicant has

MCRC No. 5788 of 2020 allegedly committed theft of seven goats on 14.03.2020.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the fact that the applicant is in jail since 30.07.2020 and the offence is triable by JMFC, this Court is inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
