Mr. Anant Bajpai, Panel Lawyer, for the State. This is an application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No.278/2015 registered at P.S. State Level Flying Squad, Raipur, District Raipur (C.G) for the offence punishable u/s 34(1)(A)(2)(, 59(A) of the C.G. Excise Act.

As per the prosecution case, on 18.09.2015 when a raid was conducted by the Flying Squad, Raipur the applicant was found to be carrying illicit liquor of 306 bulk litres. After seizure having been made, the applicant was taken into custody.

Learned counsel for the applicant disputes the recovery of liquor from the applicant of submits that the applicant has been falsely implicated in this case. He further submits that the charge sheet has been filed in this case and the applicant is in jail since 18.09.2015. He prays for releasing the applicant on bail.

Per contra, learned State Counsel opposes the bail. Looking to the quantity of liquor allegedly recovered from the applicant, I am not inclined to release him on bail at this stage.
