Prayer is made in this instant petition to direct the learned JMFC, Jaijaipur, District Janjgir-Champa to decide the unregistered complaint filed by the petitioner in the year 2011 within stipulated period. Photo copy of the order sheet of the JMFC is filed. Order sheet dated 28/11/2015 record that time was sought for to file closure report. Thereafter, no report has been filed and it is pending before JMFC.

Petitioner may file suitable application before the JMFC to seek his redressal and the JMFC may thereafter pass the order after calling entire case diary or the FIR or investigation if any is carried out by the police. 3.

In view of this, since the issue involves overlapping facts and proper adjudication can be made after certain judicial pronouncement is made on the application if any filed by the petitioner before the JMFC. At this stage, it would be premature to give any direction to the JMFC as it may prejudice right of the parties. Petitioner if so advised may file suitable application before the JMFC.
