The present contempt petition has been filed alleging noncompliance of the order dated 19.02.2019 passed by this Court in WPS No. 1080 of 2019. The direction given by this Court in the said writ petition was to consider the claim of the petitioner and to pass an appropriate order, so far as his claim for pension and gratuity for that period he rendered as a daily wage employee is concerned. Records show that respondent authority vide their order dated 30.04.2019 have passed an order holding that the petitioner is not entitled for the benefits of pension and gratuity for that period he has worked as a daily wage employee.

In view of the fact that the respondents have passed an order and taken a decision denying the claim of the petitioner, this Court is of the opinion that the order and the directions given by this Court stand duly complied with.

If at all, if the petitioner is not satisfied with the said finding, the option left for the petitioner is to challenge the same by way of a fresh proceeding. The same can not be tested under the contempt jurisdiction, since the directions given by this Court was only confined to pass an appropriate order.

With the aforesaid observations, the present contempt petition stands rejected.
