1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.777/2013, registered at Police Station Chhawni, Distt. Durg, for the offence punishable under Sections 147, 148 and 302 read with Section 149 of the IPC.

2. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the manner in which on 4-11-2013 the applicant and other co-accused murdered Anil Singh and thrown the dead body into a tank, testimonies of eyewitnesses available on record and material available, I am not inclined to grant bail to the applicant. The application is rejected.
