1. Heard.

2. It is argued that the petitioner, who is working as Lecturer (Panchayat), within the jurisdiction of Zila Panchayat, Jashpur is

suffering from acute spinal cord problem (Prolapse of L4-L5), therefore, he made an application for his transfer to his native place at Raigarh, however, the same was rejected on 4.12.2015 by the CEO, Zila Panchayat, Jashpur.

3. The petitioner had already preferred WPS No.501/2016, which came to be disposed of on 22.2.2016 directing the CEO, Zila Panchayat, Jashpur to take a decision on his application.

4. Mr. Mahendra Dubey, learned counsel for the petitioner, would submit that on the date of passing of the said order dated 22.2.2016, the petitioner was not aware that his application has already been rejected. He submits that the petitioner is willing to move a fresh application before the Secretary, Department of Panchayat and Rural Development so that the matter is considered at the appropriate level.

5. The petitioner is at liberty to move an application before the Secretary, Department of Panchayat and Rural Development and if such application is moved, the same shall be considered by the said authority in accordance with law.
