This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.190/2014, registered at Police Station-Surajpur, District-Surajpur (CG), for the offence punishable under Section 395 of the IPC.

Case of the prosecution, in brief, is that an F.I.R. was lodged by one Gulam Ansari alleging that on 7.5.2014 at about 9 p.m. when he was returning along with Sabbir Ansari, Mustaffa, Aslam, Ijarat and Manjur Ansari after purchasing cattles, near village Nareshpur 7 to 8 persons including the present applicant assaulted them and committed dacoity of cash amounting to Rs.13,700/- and three number of mobiles. 3.

After hearing learned counsel for the parties and in view of the fact that seizure has been made and further taking into note that 12 prosecution witnesses out of 15 charge-sheeted prosecution witnesses have been examined, I deem it appropriate to direct the trial Court to expedite the trial and conclude the same as early as possible. 4.

Accordingly, the bail application is disposed of. The trial Court is

directed to expedite the trial and conclude the same as early as possible preferably within a period of two months from the date of receipt of certified copy of this order.
