The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.288/2020, registered at Police Station Pallari, District Baloda Bazar - Bhatapara (C.G.) for the offence punishable under Sections 363, 376, 376DA & 376F of the IPC and Sections 4 & 6 of the POCSO Act.

Learned State counsel would inform that while filing the charge sheet, the concerned Police has also added offence under Section 3 (2) (V) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short 'the Act, 1989).

In view of the above, the applicant is required to file an appeal under Section 14A of the Act, 1989. Accordingly, the bail application is dismissed with liberty to the applicant to prefer a duly constituted appeal.

Annexure-A-1 filed by the applicant be returned to him on supplying xerox copy thereof.
