The petitioner is retired employee of respondent No.2. This petition has been filed by the petitioner seeking a direction to respondent to consider his claim for grant of promotion to the higher post of Accounts Officer on notional basis and benefit of higher pay scale and other benefits.

The averments made in the petition show that while the petitioner was continuing in service, a criminal case was instituted and departmental enquiry was also instituted.

The pleadings also show that later on, in the criminal case, he was acquitted and the departmental enquiry has already been closed on 07.07.2011. The petitioner eventually retired on 31.07.2012. Number of

representations has been made but the claim of the petitioner for grant of promotion to the higher post on notional basis has not been decided till date.

Considering that the petitioner is a retired employee, at this stage instead of keeping in matter pending, it would be proper to direct respondent No.2/Corporation to consider petitioner's claim and take appropriate decision on the same within a period of four months from the date of receipt of copy of this order.

The decision shall be taken duly communicate to the petitioner. If the petitioner's grievance is not redressed, it would be open for the petitioner to take appropriate steps.
