Agrawal Order On Board / 11 /2015 (1) The accused/applicant has moved this Second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 366/2012 registered at Police Station Chhavani, Distt. Durg for the offence punishable under Section 302 of the Indian Penal Code. (2) The applicant's first bail application was dismissed on merits by order of this Court dated 25.06.2015 passed in M.Cr.C. No. 2883/2015. (3) Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, I do not find any change in
circumstances to entertain this second bail application, therefore, this second bail application is rejected.
(4) However, learned counsel appearing for the applicant submits that this Court, while rejecting applicant's first bail application, directed the trial Court to decide the case within four months but till date the trial has not been completed.
(5) A report from the concerned trial Court be called as to why the order dated 25.06.2015 passed by this Court has not been complied with in its letter & spirit within four weeks from today. Sd/- (Sanjay K. Agrawal) Judge D/-
