The applicant has preferred this first bail application under Section 439 of CrPC, as he has been arrested in connection with Crime No.97/2016, registered at Police Station Rajpur, District Balrampur-Ramanujganj (C.G.) for the offence punishable under Section 302 read with Section 34 of IPC.

Learned counsel for the applicant seeks permission of the Court to withdraw the bail application with liberty to file afresh. 3.

Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.
