This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Crime No.64/2016, registered at Police

Station Baradwar, for the offence punishable under Sections 414, 34 of I.P.C.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; the manner in which applicants said to have stolen motorcycle and consequent recovery from their possession and material available in the case diary, this Court is not inclined to release the applicants on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
