1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 17.06.2021 in connection with Crime No. 57/2021 registered in Police Station- Bhatgaon, District BalodabazarBhatapara (CG) for the offence punishable under Section 306 of IPC.

2. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

3. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
