(1) The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 201/2015 registered at Police Station Takhatpur, District Bilaspur for the offences punishable under Sections 34(2) & 59(a) of the Chhattisgarh Excise Act, 1915. (2) Applicant's first bail application is dismissed as withdrawn with liberty to file the same after conclusion of the earlier criminal
case relating to excise offence by order of this Court dated 17.08.2015 passed in M.Cr.C. No.4014/2015.
(3) Having heard learned counsel appearing for the parties, having regard to the facts & circumstances of the case, I do not fine any change in circumstances to entertain this second bail application. Thus, the second bail application is rejected. Certified copy, as per rules.
