Shri Chandresh Shrivastava, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order On Board
20/06/2018 The challenge in the present writ petition is to the order dated 05.06.2018 Annexure P-2 whereby the services of the petitioner have been placed under suspension under the provisions of CG Civil Services Conduct Rules, 1965.
2.
As per the provisions of Rule 23 of CG Civil Services Conduct Rules, the order of suspension is an appealable order. The petitioner in the instant case seems to have not preferred any appeal against the said order and straightway filed the present writ petition. Since there is an alternative efficacious statutory remedy of appeal available to the petitioner, this Court is not inclined to entertain the petition at this juncture. 3.
Accordingly, reserving the right of the petitioner to prefer an appeal against the order of suspension, the present writ petition stands dismissed of as not maintainable.
