1. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 19.03.2018 in connection with Crime No.80/2018 registered at Police Station City Kotwali, Raipur, District Raipur (CG) for the offence punishable under Section 307 IPC.

2. As per the prosecution case, on 17.03.2018 the applicant stabbed one Murli Soni on the basis of the previous enmity and the injury was sufficient to cause his death. Thereby the offence has been committed.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated and the offence under Section 307 is not made out, therefore, the applicant may be released on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail.

5. Perused the statement of the victim as also the medical report. Considering the same, I am not inclined to release the applicant on bail.
