Hon'ble Shri Justice Goutam Bhaduri Order 28.08.2020 Heard.
1. Learned counsel for the petitioner submits that the mother of petitioner died in harness in the month of September, 2019, thereafter the petitioner has submitted an application for compassionate appointment. He would further submit that since, the petitioner is holding the requisite qualification, she had requested to be appointed as Assistant Grade-III but she was informed that Assistant Grade-III post is not vacant. Therefore, prayer is made that as and when the post of Assistant Grade-III would fall vacant she may be appointed.
2. The nature of prayer made cannot be allowed as on date that in future if the post will fall vacant she would be appointed to the post of Assistant Grade-III by way of compassionate appointment. There cannot be indefinite, time line for order to be implemented on happening of certain
event. Therefore, in near future within a reasonable time if the post of Assistant Grade-III fall vacant, she may apply and may file an application for compassionate appointment and the State would be at liberty to decide the same in accordance with law and circular governing this field.
