The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 279/2015 registered in Police Station Kota, District Korba (C.G.) for offence punishable under section 294, 394, 506B, 323, 324, 325/34 of IPC.

As per the prosecution case, applicant along with co-accused Manoj Koushik has committed loot of a motorcycle which belongs to Jaidev and thereafter kept it with them and when the complainant along with others went to get back the motorcycle, they were attacked and subsequently on a report being made, the applicant was arrested and the charge sheet has been filed.

Learned counsel for the applicant submits that similarly placed coaccused has been granted bail by this court in M.Cr.C. No.5884 of 2015 on 4/11/2015 and the applicant is in jail since 24/08/2015, therefore the applicant may be released on bail.

Learned State counsel on verification do not dispute the fact that

similarly placed co-accused has been granted bail by this court in M.Cr.C. No.5884 of 2015 on 4/11/2015.

Having regard to the fact that similarly placed co-accused has been granted bail by this court in M.Cr.C. No.5884 of 2015 on 4/11/2015 and the applicant is in jail since 24/08/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
