Sam Koshy Order on Board 14/06/2016 The present criminal revision has been preferred against the order dated 30-01-2016 passed in Criminal Appeal No.06/2016 by Additional Sessions Judge, Jashpur, District Jashpur (C.G.) wherein the Additional Sessions Judge has affirmed the order passed by Juvenile Justice Board on 20-01-2016 under Section 12 of the Juvenile Justice (Care and Protection of Children) Act, 2000 seeking bail to the applicant.
2) As per the prosecution case, it is said that the present applicant is said to have committed rape on the prosecutrix on 09-12-2015 and a report was lodged by the prosecutrix on 10-12-2015. The record reveals that the present applicant is aged about 161⁄2 years and the prosecutrix is a married woman. Record also reveals that the Probationary Officer has given his report stating that the applicant
is involved in serious act of misconduct and is also morally not grown up and there is likely of his going to wrong company, therefore, he objected to release the applicant on bail.
3) Considering the totality of the facts and circumstances of the case and also considering the nature of offence committed by the applicant, this Court is of the opinion that this is not a fit case in which the applicant can be released on bail. 4) Accordingly, the present revision petition is liable to be and is hereby dismissed.
