1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 323 of 2015 registered at Police station Kotra Road, District Raigarh (C.G) for the offences punishable under section 15-B of the Narcotic Drugs and Psychotropic Substances Act 1985.

2. As per the prosecution case, when a raid was conducted on 10.11.2015 the applicant was found in possession of 2450 grams of Poppy Straw in his bag and the same was seized from his possession.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the seizure was not made from the applicant. He further submits that the looking to the quantity of contraband substance he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of bail.

5. Having regard to the case diary documents, prima facie, it appears that the applicant was found in possession of 2450 grams of Poppy Straw which is more than small quantity and less than commercial

quantity and considering the seizure made from his possession, I am not inclined to allow this bail application, at this stage. Accordingly, it is dismissed.
