Hon'ble Smt. Justice Rajani Dubey Order On Board 03/09/2020

1. By this CrMP, the petitioner seeks modification of the order dated 07.02.2020 passed in MCRC No. 8403/2019 regarding the surety amount granted by this Court.

2. This Court while deciding MCRC No. 8403/2019, considered all the aspects of the matter and looking to the nature of the offence committed by the applicant granted the bail on her executing a personal bond for a sum of Rs. 50,000/- with one local surety.

3. Learned counsel for the petitioner submits that the order

dated 07.02.2020 could not be complied with due to the fact that nobody is coming to support the petitioner and she is unable to furnish local surety of Rs. 50,000/- before the trial Court and, therefore, she is in jail. He further submits that he has filed an application for exemption from furnishing the surety (I.A. No. 01/2020). Counsel for the petitioner orally submits that he does not want to press the I.A. No. 01/2020, and prays that the order dated 07.02.2020 passed in MCRC No. 8403/2019 may be modified and the surety amount may be reduced.

4. In view of the aforesaid facts and circumstances of the case, the order passed in MCRC No. 8403/2019 is modified and surety amount of Rs. 50,000/- is reduced to Rs. 15,000/-.and the I.A. No. 01/2020 is dismissed as not pressed.

5. It is directed that the petitioner shall be released on bail on her executing a personal bond for a sum of Rs. 15,000/- with one local surety in the like sum to the satisfaction of the trial Court.

6. Accordingly, the CRMP is disposed of.
