At the very out set, it is submitted on behalf of the petitioner that the petitioner may be permitted to withdraw this petition with liberty to file an application afresh under the provisions of Section 13 of the Family Courts Act, 1984 and the Court below may consider the same on its merits without being influenced to the order dated 16.2.2016 passed by the trial Court. 2.

On due consideration, the instant Cr. M.P. is disposed of as withdrawn reserving the aforesaid liberty as prayed for. 4.

Needless to mention that, if any, application under Section 13 of the Family Courts Act is filed, the Court may consider and decide it on merits in accordance with law and the order dated 16.2.2016 shall not come in the way. 5.
