The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 342/2015 registered in Police Station Baradwar, District Janjgir-Champa (C.G.) for offence punishable under section 457, 380 of IPC.

As per the prosecution case applicant committed theft of one mobile and Rs.5000/- from the house of the complainant and on report lodged by the complainant Thakur Ram Chandra on subsequent investigation same mobile recovered from the possession of applicant. 3.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case and considering the seizure made and the report no further evidence is required, therefore he submits that applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 4.

Taking into account facts and circumstances of the case, also

considering the nature and gravity of offence and also considering the detention of the applicant that he is in jail since 16/11/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
