1. Applicant- Sunil Tiwari has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail in connection with Crime No. 190/2020 registered in Police Station- Somni, District - Rajnandgaon (CG) for the offence punishable under Sections 365, 364A, 120B, 34 of IPC.

2. Applicant- Gyanendra Pratap Singh @ Lallu has preferred this second bail application under Section 439 of Cr.P.C. as he is in jail in connection with

Crime No. 190/2020 registered in Police Station- Somni, District - Rajnandgaon (CG) for the offence punishable under Sections 365, 364A, 120B, 34 of IPC.

The first bail application of applicant- Gyanendra Pratap Singh @ Lallu was rejected on merits by this Court vide order dated 18.03.2021 passed in M.Cr.C. No. 918 of 2021.

3. Shri Sharad Mishra, learned counsel appearing on behalf of applicant in M.Cr.C. No. 4162/2021, prays for time to argue the bail application. At the request of learned counsel for the applicant, list this bail application (M.Cr.C. No. 4162/2021) after four weeks.

4. Shri Ankur Agrawal, learned counsel appearing on behalf of applicant in M.Cr.C. No. 5662/2021, seeks to withdraw this second bail application with liberty to file a fresh application as and when occasion arises.

5. Accordingly, the bail application (M.Cr.C. No. 5662/2021) is dismissed as withdrawn with the liberty as stated above.
