1. Heard.

2. These are two applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.141/2020 registered at Police Station Pussore, District Raigarh (CG) for the offence punishable under Section 420/34 of the IPC.

3. The applicants have allegedly uploaded 'Kisan App' on their mobiles and induced the villagers to get themselves registered for seeking benefit of Pradhan Mantri Kisan Samman Nidhi Yojna, in which, three installments of Rs.2000/-, total Rs.6000/- are disbursed to the eligible agriculturists. It is alleged that after the applicants registered 26 persons by obtaining Rs.1000/- from each of them, they were disbursed the first installment of Rs.2000/- each, but later on, it came to the notice of the authorities that the 26 persons, who have registered themselves under the Pradhan Mantri Kisan Samman Nidhi Yojna, were not eligible for the benefit as they are landless persons.

4. In the course of hearing, it is informed that the responsibility to verify as to whether a person registered has any land in his name or not, was on the shoulders of the ofÏcers of the State Government.

5. Considering the fact that offences are triable by the Judicial Magistrate First Class and the applicants are in jail since

29.7.2020, this Court is inclined to release the applicants on regular bail.

6. Accordingly, the bail applications are allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
