The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 230/2015 registered in Police Station Dongargaon, Distt. Rajnandgaon Revenue/Civil Distt. Rajnandgaon (C.G.) for offence punishable under section 457, 380 of Indian Penal Code.

As per the prosecution case on 13/08/2015 a theft of agricultural medicines was committed from the medical shop which was reported by the complainant on 14/08/2015 and thereafter on investigation being made, the applicant was arrested.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the charge sheet has been filed. He further submits that similarly placed co-accused Bhupendra Kumar has been granted bail by this court in M.Cr.C. No.6257/2015 on 23/11/2015, therefore, the applicant may also be released on bail. 4.

Learned State counsel on verification submits that similarly placed

co-accused Bhupendra Kumar has been granted bail by this court in M.Cr.C. No.6257/2015.

Having regard to the facts and circumstances of the case and also for the fact that similarly placed co-accused Bhupendra Kumar has been granted bail by this court in M.Cr.C. No.6257/2015, therefore on the ground of parity, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
