1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 401/2015 registered at Police Station Raipur Distt. Raipur (C.G) for the offences punishable under Sections 307 IPC & Section 25 & 27 of the Arms Act.

2. As per the prosecution case, the complainant Kamlesh Dwivedi was working as Guard in a wine shop. He lodged a report that in the mid night of 08.08.2015 the applicant came to the shop and asked to open the shutter of the shop and demanded money. On being refused, the complainant was assaulted with knife. Subsequently, on investigation, the application was arrested.

3. Learned counsel for the applicant submits that applicants have been falsely implicated in this case and initially the FIR was filed against an unknown person and subsequently he has also not been identified.

4. Per contra, learned State Counsel opposes the prayer for grant of bail and submits that against this applicant, 4 cases of similar nature have been registered in 2013, 2014 and 2015.

5. Considering the past antecedents of the applicant, I am not inclined to allow the bail application. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE Rao
