Mr. Chandresh Shrivastava, Advocate for the respondents. The present contempt petition has been filed alleging noncompliance of the order dated 03.02.2021, passed in WPS No. 214/2021. The observation by the order of this Court was to the respondents to consider the claim of the petitioners for promotion from the post of Training Officer to the post of Training Superintendent. Today, when the matter is taken up for hearing, learned counsel for the respondent has produced before this Court an order dated 13.10.2021, whereby they have reflected that the very appointment of the petitioners at the first instance itself is not in accordance with the rules of governing the field and a show cause notice has already been issued to the petitioners herein seeking their explanation as to why their appointment should not be cancelled.

In view of the fact that the State Government has taken a decision vide order dated 13.10.2021, the contempt petition as of now stands disposed of reserving the right of the petitioner to challenge the show cause notice issued by the Department.
