1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 29.03.2021 in connection with Crime No. 46/2021 for offence punishable under Sections 302, 120-B, 201/34 of IPC, registered at Police Station- Police Chowki Balangi, Police Station Raghunathnagar, District- Balrampur-Ramanujganj (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
