1. Learned counsel for the appellant seeks permission of this Court to withdraw this appeal with a prayer that the documents filed during the course of trial before the trial Court may be returned to the appellant.

2. Accordingly, the second appeal is dismissed is withdrawn.

3. Since the documents were filed before the trial Court, the appellant is at liberty to make suitable application for return of documents before the trial Court.
