None Hon'ble Shri Justice P. Sam Koshy Order on Board 31.08.2020

1. The present MCC has been filed seeking extension of time for compliance of the Order dated 16.12.2019 passed in WPC No. 4592 of 2019 (Annexure A-1).

2. The contention of the counsel for the applicant seeking extension of time is that the Order dated 16.12.2019 was submitted by the

-2petitioner before the present applicant only on 06.03.2020 and thereafter because of the lockdown and the pandemic situation prevailing, necessary compliance could not be done within time and it is in the process of verification as to the actual entitlement of the petitioner. The counsel for the applicant in the present MCC submits that within a further extended period of sixty days' time, the applicantauthorities would be able to settle the claim of the petitioner after due verification of the facts.

3. Having heard the contentions put-forth on the part of the counsel for the applicant, it reflects that the applicant was served with the Order of this Court dated 16.12.2019 only on 06.03.2020 and thereafter it was the lockdown situation for a pretty long time and even after relaxations given to the lockdown, things were not normalized, therefore, sometime could have taken.

4. The reasons assigned by the counsel for the applicant seems to be bonafide and justified and accordingly, this Court is of the opinion that the applicant deserves extention of time for a further period of sixty days starting from today within which, the authorities shall verify the entitlement of the petitioner and try to redress the grievance inaccordance with law.

5. Accordingly, the present MCC stands allowed and disposed off. The applicant's counsel herein is granted sixty days' time for compliance of the Order dated 16.12.2019. Let a copy of this Order passed in the present MCC be made a part of record of WPC No. 4592 of 2019. Sd/- (P. Sam Koshy) Judge Rahul
