The applicant has been arrested on 22.02.2016 in connection with Crime No. 487 of 2015 registered at Police Station, Sarkanda, District Bilaspur for the alleged commission of offences under Sections 411, 457 and 380 of the Indian Penal Code.

Case of the prosecution is that the applicant has been purchasing stolen silver and gold items knowing fully well that they are stolen articles. 3.
Learned counsel for the applicant submits that even according to the memorandum of the co-accused, Ganesh @ Ramesh Soni, he used to purchase the stolen gold and silver ornaments which were later on converted into small bars and then in turn it was sold in the open market and number of jewellers including the applicant. The detention of applicant is no longer necessary as the investigation is complete and charge sheet has already been filed, and therefore, he may be granted bail.

On the other hand, learned counsel for the State has opposed the bail application and submits that the applicant is also involved in commission of the offence as he is engaged in purchase of stolen articles. 5.
Having heard learned counsel for the parties, taking into consideration the totality of the circumstances, nature of allegation and that the investigation is complete, charge sheet has already been filed and further detention does not appear to be necessary for progress of the trial, the application is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond of Rs. 20,000/- alongwith one local surety for the like amount to the satisfaction of the trial court. He shall appear before the Court below on each and every date given to him by the said Court till disposal of the trial.
