(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 29.07.2014 in connection with Crime No.220/2014 registered at Police Station Pandri, District Raipur, for the offence punishable under Sections 450, 376 & 506-B of the Indian Penal Code.

(3) The applicant's first bail application was dismissed as withdrawn with liberty to file the same after examination of all the material prosecution witnesses by order of this Court dated 09.03.2015 passed in M.Cr.C. No.1048/2015 and second bail application of the applicant

was dismissed for want of prosecution by order of this Court dated 27.11.2015 passed in M.Cr.C. No.4824/2015.

(4) The third bail application has been filed by the applicant without examination of the prosecutrix before the trial Court and, as such, the third bail application cannot be entertained in view of the order dated 09.03.2015.

(5) The applicant is free to file bail application after examination of the prosecutrix as prayed earlier.

(6) The third bail application as framed and filed is dismissed reserving liberty in favour of the applicant. (7) Certified copy as per rules.
