This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 61/2016, registered at Police Station-Mana Camp, Distt. Raipur (C.G.), for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; considering the criminal antecedents of the applicant as 38 criminal cases of different nature were registered against him and few of them are pending consideration, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
