Instant petition for contempt is filed alleging non-compliance of the order dated 9/10/2014 passed in W.P. (C) No.1948/2014. 2.
Perusal of the order dated 9/10/2014 would show that petitioner was given liberty to file representation against notice issued to him to satisfy that he was not responsible for any shortage of paddy and the time limit to file a representation was given for 15 days from 9/10/2014. Record would show that after 9/10/2014 representation was made by the petitioner on 18/10/2014 by Annexure C-3.

Order further records that in the event of such representation is made, respondent No.2 who is Chief Executive Officer was required to enquire the matter and take appropriate steps on the basis of the enquiry. It appears that thereafter the issue became dormant and now after three
years the petitioner is coming out alleging such contempt. In any case if the order of 9/10/2014 was not complied consequent to representation made, the petitioner should have approached this court within a period of 1 year from the date on which contempt is alleged to have been committed as per Section 20 of the Contempt of Courts Act, 1971. 4.
Considering the facts, I am not inclined to entertain this petition as apparently is barred by time and it is dismissed accordingly. Sd/- (Goutam Bhaduri) JUDGE gouri
