For Non-Applicant : Shri Gagan Tiwari, Deputy GA. Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 27/10/2020 :

1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.515/2020 registered in Police Station Outpost Jutmil, PS City Kotwali, Raigarh District Raigarh for offence under Section 294, 506, 323 and 307/34 of the IPC.

2. In course of hearing, it was informed by the State Counsel that at the time of filing of charge sheet offence under Section 3 (2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short 'the Act, 1989') has also been added against the

applicant. In view of the above, the applicant is now required to move an Appeal under Section 14-A of the Act, 1989.

3. Accordingly, the application is dismissed with liberty to the applicant to prefer duly constituted Appeal under Section 14-A of the Act, 1989. True copy of the bail rejection order be returned to counsel for the applicant as per rules.
