This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 169/2015, registered at Police Station Rajim, District Gariyabandh, C.G., for the offence punishable under Sections 363, 366, 376(2)(N) of I.P.C. &
4, 5, 6 of Protection of Children from Sexual Offences Act, 2012.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; the manner, in which, on 13/08/2015, applicant is said to have caused penetrative sexual assault to the minor prosecutrix and material available in the case diary, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, trial Court is directed to expedite the trial.
