This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No.425 of 2015, registered at Police Station Telibandha, Raipur (C.G.) for offence punishable under Sections 294, 506, 307 & 34 of Indian Penal Code. 2.
As per the prosecution case one S. Narayan Rao made a report on 15/11/2015 that when he was coming along with his friend Ishwar Sahu and others from Marin Drive to Telibandha, at that time when they crossed the Telibandha square the applicant gave a cut by the bike wherein they entered into altercation at that time one of the co-accused has assaulted by way of knife in the abdomen of the complainant. 3.
Learned counsel for the applicant submits that applicant has been falsely implicated in this case and no offence has been committed. Therefore, learned counsel submits that the applicant may be granted benefit of anticipatory bail.

Learned State counsel opposes the prayer for grant of anticipatory bail.

I have perused the case diary. Primary allegations have been attributed against the applicant and presence of applicant cannot be disputed. Taking into account role played by this applicant, I am not inclined to extend benefit of anticipatory bail to the applicant. 6.
Accordingly, the anticipatory bail application is dismissed. Certified copy as per rules.
