1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicant in connection with Crime No. 146 of 2015 registered at Police station Gariyaband, Distt. Gariyaband (C.G) for the offences punishable under sections 307, 302, 498 IPC.

2. As per the prosecution case, the applicant who had married Smt. Padma Bai, on a dispute poured kerosene oil on her body and set her ablaze and thereafter she died of burn inuries.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the offence has not been committed.

4. Per contra, learned State Counsel opposes the prayer for grant of bail and submits that the charge sheet contains the dying declaration.

5. Perused the dying declaration wherein direct allegations have been attributed against this applicant. Considering the dying declaration, I am not inclined to release the applicant on regular bail. Accordingly, the bail application is dismissed. Sd/- GOUTAM BHADURI JUDGE Rao
