Both the appeals arise out of the same judgment rendered by the Court of Additional Sessions Judge, Bhatapara, District Baloda Bazar, in Sessions Trial No.H30/2018. Since, CRA No.771/2021 has been preferred by engaging a counsel of appellant's choice and the said appeal has been preferred prior in point of time, the subsequent appeal i.e. CRA No.794/2021 preferred through High Court Legal Services Committee does not survive for adjudication.
Accordingly, CRA No.794/2021 is dismissed as not maintainable.
